Terms of use for Sailforce

Clear and as short as possible: what Sailforce is, what it isn’t, and how Pro works.

1. Provider and scope

These terms apply to the use of the “Sailforce” app (“the app”). The provider is Philipp Masztakowski, trading as PositiveLifeApps, Zonser Str. 23, 50733 Köln (Cologne), Germany (“I”).

You get the app through Apple’s App Store. The licence to use it is governed by Apple’s standard Licensed Application End User License Agreement (EULA). These terms add points that matter specifically for Sailforce.

2. What the app offers

Sailforce illustrates sailing physics. The free version includes the 2D top view with course ring, sheets, wind triangle, force arrows and trim hints, plus a preview of the 3D view. Sailforce Pro additionally unlocks the interactive 3D yacht with physics simulation, manoeuvres, wind lines, the cutaway through the sail and extended trim tips. 3. A learning model – no substitute for training and seamanship

Sailforce is a teaching and explanation tool, not a navigation device.

  • The app shows physical relationships in simplified form. It is tuned to a typical 38–40 ft charter yacht; the speeds and forces shown are guide values and do not transfer to any particular boat.
  • The app does not replace sailing training, a boating licence, practical instruction or seamanship.
  • The app is not a navigation aid and not a basis for decisions on course, manoeuvres or safety on board. Do not use it to steer or navigate.
  • Responsibility for handling a boat safely always lies with the skipper and crew.

4. Trip pass and subscriptions

You can unlock Sailforce Pro in the app in three ways:

  • Trip pass · 1 week (€3.99): one-off purchase. Pro is active for seven days from purchase and then ends by itself. The pass does not renew and needs no cancellation.
  • Pro monthly (€8.99 per month): subscription that renews by one month at a time.
  • Pro yearly (€24.99 per year, introductory price): subscription that renews by one year at a time.

The prices stated apply to Germany and include VAT. The price shown in the App Store before purchase always prevails and may differ in other countries. There is no free trial.

For subscriptions: payment is charged to your Apple ID when you confirm the purchase. A subscription renews automatically for the same period unless you cancel it at least 24 hours before the end of the current period. You manage and cancel subscriptions in your Apple ID settings. After cancelling, Pro remains active until the end of the period already paid for. Price changes for running subscriptions follow Apple’s rules; Apple informs you in advance.

Handled by Apple: purchase, payment, invoice, any right of withdrawal and refunds are handled by Apple and governed by Apple’s Media Services Terms. On a new device, use “Restore purchases” in the app’s settings. Help is available in Support.

5. Liability

I am liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slightly negligent breaches of an essential contractual obligation – an obligation whose fulfilment makes the proper use of the app possible in the first place and on which you may rely – liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded.

Your statutory rights in the event of defects in the app remain unaffected.

6. Updates and availability

I keep developing Sailforce and provide updates through the App Store. I aim for the app to run reliably on current iPhone and iPad models with current iOS versions. Individual features may change through updates as long as the core of the respective offer is preserved.

7. Rights of use

The app, its content, graphics and the 3D model are protected by copyright. Within Apple’s EULA you may use the app privately and for training on board, for example to explain something to your crew.

8. Changes to these terms

I may update these terms, for example for new features or changes in the law. Changes that would significantly disadvantage you do not apply to periods already paid for. The current version is always available on this page.

9. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you retain the protection of the mandatory provisions of the country in which you habitually reside.
